Two men who were both facing simple larceny charges after they were caught transporting material from a construction site, were freed when they appeared in the Corporate Area Resident Magistrate's Court yesterday.
Tyrone Folkes and Lloyd Lewis were both admonished and discharged after the complainant revealed that he had received his property and was no longer interested in pursuing the matter.
The court was told earlier that Folkes was a watchman employed to guard the premises but was seen aboard a truck driven by Lewis. Steel, cement and PVC pipes were also found on the truck. The morning after the men were caught, the complainant discovered the items missing from the site.
Both men pleaded guilty yesterday and were let off with a warning from Resident Magistrate Glen Brown, after strong representation was made by Lewis' attorney. He told Lewis, "When people steal things, they don't move them in the day. When you see people moving things at that time, usually it's stolen goods."
RM Brown told the court that he was being lenient towards Folkes because of the complainant's request and because he had already spent about 21 days in jail.
