Accused rapists remanded

Two men accused of being among five men who allegedly raped a woman were remanded when they appeared in the Corporate Area Resident Magistrate's Court on Wednesday.

Charged with rape, abduction, indecent assault and conspiracy are Hamidullah Muwwakkap and Asheen Allen.

Allegations read in court are that the two accused and the complainant went to a party together and when they left, the men allegedly took her to a location and took turns having sex with her.

The court heard that five men were involved in the matter. The crown indicated that it was opposed to bail because the complainant and the men all lived in the same area and she has been receiving threats. In addition, the crown said that the three other men were still at large.

However, the men's attorney argued that the complainant did not say anything in her statement to suggest that she was raped. The attorney said that in the complainant's statement, she named two men, who she said was having sex with her, and then she blocked out and awoke in her bed. She said when she woke up, she discovered her chain was missing.

HIV test

The defence attorney argued that the accused did not tell anyone about the alleged rape, until she went to the doctor where she asked for an HIV test and a test for vaginal infections. The attorney said she did not test positive for HIV but a vaginal infection was found.

He said the complainant frequently visited the accused men's family homes and that there was no evidence that she had been abducted or that she did not consent to the sex.

However, the crown maintained that it was opposed to bail and added that the complainant did indicate that she was drunk.

Senior Resident Magistrate Glen Brown denied them bail and ordered the accused men's fingerprints be taken. Both are to return to court on August 13.
