A Montego Bay architect who failed to deliver on an agreement between herself and a client has been hauled before the court to answer fraudulent conversion charges.
Pinksque Green, 28, of Hendon Norwood, was granted bail after a successful bail application in the Montego Bay Resident Magistrate's Court on Wednesday.
The subject matter of the charge is $60,000, which was allegedly paid over to her to draft a plan for the expansion of the complainant's house.
The complainant reported that in September 2007, she entered into an agreement with Green to pay her $60,000 to draft the plan. She reportedly paid half the sum in October and completed payments in November.
However, since the final payment she was unable to see or speak to Green. A report was subsequently made to the police.
Turned her in
The court was informed that Green was arrested on May 7 after someone, who knew about the allegations, turned her in.
Defence attorney Morrel Beckford in his bail application, said that the matter should not have been brought before the criminal court and suggested that it is a civil court case.
He stated his disagreement with the charge, arguing that fraudulent conversion indicates that money handed over for a specific purpose was used otherwise. In this case however, he says that his client does not deny getting money from the complainant for a plan.
The lawyer said his client had shown the plan to an engineer, in the presence of the complainant, but was waiting for the engineer to make his additional adjustments, and added that she was not evading the complainant. Green is however yet to get the document from the engineer.
RM Winsome Henry, though granting bail, said Green should have communicated the difficulties to the complainant. Green was offered $100,000 bail with the condition that she reports to the Montego Freeport Police Station on Thursdays. She returns to court on June 18.
