Two Flankers residents who were accused of killing a man in the community in November, will remain behind bars as they await the start of the preliminary enquiry.
The enquiry into the case against the men, 28-year-old chef, Melville Hendricks and fisherman Oraine James, 24, is set to begin on February 28, despite outstanding scene of the crime and forensic reports.
The date was set after attorneys Trevor Ho-Lyn and Charles Sinclair appeared on behalf of the men and said that the outstanding statements should not delay setting a preliminary date since they will not link the accused men to the offence.
Solely on eyewitnesses
He said that the case would be based solely on eyewitnesses, as the men were not held with any weapons or other items that could link them to the murders.
Allegations are that about 6:15 a.m.on November 1, Hendricks drove up in a car with James and three other men to a shop in Red Dirt, Flankers.
It is said that the five men alighted from the vehicle and proceeded to shoot at the deceased, Roger Moore. Moore ran and was shot in the back of the head. The men then got back into the vehicle and sped away.
In previous bail applications, Mr. Sinclair argued that the witnesses' descriptions of the alleged perpetrators did not fit those of the accused men. He also questioned why the men were never placed in an identification parade so that the witnesses could make a positive identification.
The men were remanded and subpoenas ordered for the witnesses.
