AN ALLEGED CONFRONTATION between two men has left one dead and the other before the court facing a murder charge.
Charged with murder is 38-year-old Dean Waite of Mt Salem, St. James. He was remanded in custody on Friday when his case was mentioned for the first time in the Montego Bay Resident Magistrates' Court.
His attorney George Thomas, who made an application for bail, argued that there was never a confrontation between his client and the deceased, 47-year-old Carl Williams. He said that Williams had intervened in a conversation between the accused, a woman, and that the deceased had used a board to hit the accused. He said his client acted in self defence as he was being attacked.
The prosecution is, however, alleging that on May 6 this year the accused and the now deceased got into an argument which developed into a fight. It is further alleged that during the fight Williams used a piece of board to inflict injuries to Waite's forehead and side before running away. Waite, reportedly chased him and used a knife to stab the deceased twice in the chest.
The accused subsequently made a report to the Anchovy police who later turned him over to the Montego Bay police before he was taken to the hospital, where he was admitted for treatment of the injuries he received.
After hearing the allegations, RM Winsome Henry said that the issue of self defence is something that will have to be determined by a jury. She denied bail saying that the fact that a witness claims to have seen him chasing the now deceased and that he inflicted more than one blow suggest otherwise.
He will be brought back to court on June 5 when the case will again be mentioned.
