YET ANOTHER POLICE officer has been brought before the courts for breaches of the Corruption Preventions Act.
Constable Eveland Marks of the Admiral Town Police Station appeared before the Corporate Area Resident Magistrate's Court on Thursday, accused of demanding money from an accused to drop charges of illegal possession of firearm and ammunition.
Marks and other officers allegedly arrested a man for illegal possession of firearm and ammunition and while the man was before the court, Marks allegedly offered to drop the charges for $70,000, the court was told.
Allegations are that on November 16, 2004, Marks was on patrol with other officers when they arrested Fidel Holding for illegal possession of firearm and ammunition. The matter went before the Gun Court on November 19, 2004.
Holding's common-law wife gave a statement to police alleging that Marks called at 1:00 a.m. on February 5, 2005 and demanded $70,000 to drop the charges. She contacted the Internal Affairs Division and later gave a statement.
A sting operation was set up and the common-law wife was given a scandal bag with shredded newspaper resembling the money to deliver to Marks. They allegedly met at the Supreme Court and when the exchange was made. Marks was arrested, and charged following a ruling by the Director of Public Prosecutions.
Marks was granted $100,000 bail. He is to surrender his travel documents and a stop order was issued. He is to report to the Falmouth police every Monday, Wednesday and Saturday between 6:00 a.m. and 8:00 p.m. The matter returns for trial on March 15.
