A FACILITIES MANAGER at a company in the Montego Bay Freezone, who is accused of killing a security guard, also of the same company, was denied bail when he appeared before the Montego Bay Resident Magistrate's Court on Tuesday.
Machel Sinclair of Westgate Hills, St. James is facing a murder charge after he was identified by an eye witness as the one who shot and killed security guard Denver Stewart.
Sinclair will remain in custody until January 23 when he will again be brought before the court.
The allegations are that on December 16, Sinclair and Stewart entered into an agreement for Stewart to collect two plasma television sets (under a different name) from the company to which they are employed.
Acting on information, the Fraud Squad questioned Stewart and he agreed to give a statement against Sinclair.
It is further alleged that subsequent to the this, Sinclair contacted Stewart and offered him money for his silence. He further arranged a meeting with Stewart at the Westgate shopping centre ATM where he said he would carry out the transaction.
On December 19 at about 11:15 p.m. the two met at the shopping centre where a witness who had travelled with Stewart said he saw the two in discussion and saw when Sinclair shot Stewart.
Sinclair was positively identified by the witness on December 30 at an identification parade.
Defence attorney Clive Mullings told the court that the description of the supposed assailant, is not consistent with his client. He said that the person who is alleged to have killed Stewart was described as slim built with a small head but said that his client does not fit the description.
However, RM Wilson Smith said that the evidence presented by the prosecution suggests a very strong case against Sinclair and therefore, he was denied bail.
