FOUR MEN WHO decided to 'rinse a new tune' on their sound after they heard it on the radio found themselves $10,000 poorer when they appeared in the Corporate Area Resident Magistrate's court on Wednesday.
Demetrius Facey, Kidron Marriott, Joseph Thorpe and Kenneth Harvey were each fined $10,000 after pleading guilty to breaches of the Noise Abatement Act before RM Judith Pusey.
A fifth man Gerald Coombs, pleaded not guilty.
Verbally abused
Court files indicate that on September 9, the arresting officer was driving on Henderson Road, St. Andrew, when he saw the men playing a sound system on the road. He stopped and asked the men if they had a permit, however, the men abused him verbally forcing him to seek help.
The officer returned with other policemen and attempted to arrest the men. It is reported that they resisted and in the process the arresting officer was struck in the face. They were eventually restrained, arrested and charged.
Not guilty
In court Wednesday Coombs said he was standing nearby and was not playing any music. His not guilty was accepted and he was told to return to court on October 11.
But Harvey, Facey, Marriott and Thorpe admitted they were playing music. Marriott told the court his friend's new song was played on the air for the first time and they decided to celebrate. He said during the time the police drove up and arrested them.
The men were fined. But they pleaded not guilty to resisting arrest and assaulting a police officer and were given a October 10 court date.
