JERMAINE THOMAS, of Paradise Street, May Pen, Clarendon, was denied bail when he appeared before Senior Resident Magistrate, Glen Brown in the May Pen RM Court recently, to answer to the charges of illegal possession of firearm and robbery with aggravation.
Attorney-at-law representing the accused, Hopeton Clarke in his bail application told the court that it was a "risky case" as there was not enough evidence to say that it was his client who in fact robbed the complainant.
He added that Thomas was pointed out to the police six months after the alleged crime. He said that there was nothing to go by in pursuant of the matter, as nothing was found in his client's possession.
Clerk of Court, Miss Findley read the allegations against Thomas, adding that in a caution statement given to the police, he said, "Mi nuh rob nobody."
The allegations are that on January 27, of this year, he held up and robbed the complainant, GaWayne Wessell of a cellular phone. The report states that the complainant was standing on the Denbigh main road when he was approached by the accused who brandished a firearm and demanded all that he had in his possession.
A Sony Ericcson 230 cellular phone, which was on his person, was taken from him. The accused then escaped into nearby bushes.
Thomas was this month spotted by the complainant in May Pen and pointed out to the police. He was taken into custody and positively identified. The matter is set for mention on September 1, 2005.
