TWO OF THREE men charged with sexually assaulting a 17-year-old girl, were denied bail when they appeared before Resident Magistrate Wilson Smith in the Montego Bay RM court on Wednesday.
Damian Wolfin and Robert Glanville, who were charged along with Carlton Dove, who was granted bail on his court appearance in June, were remanded in custody because their attorney failed to convince the RM that they deserved bail.
The trio was arrested and charged in June, four months after the incident which occurred at the home of Dove and Glanville. The court heard that the girl had asked for Glanville's help in locating a friend of hers. They both went into a car driven by Wolfin and ended up at the accused men's house where the incident took place.
Defence attorney Roy Fairclough, who represents Wolfin, argued that his client was simply a driver and therefore should not have to answer to such a charge. He further argued that there is no forensic evidence that links him to the actual assault.
However, his arguments did not make a difference as RM Smith ordered that the two men be remanded.
All three men will return to court on September 1 when the preliminary examinations will begin. By then Glanville, who is presently unrepresented, will have to get himself an attorney.
