A 22-YEAR-OLD man who accused of ordering his younger brother to have sex with their sister then tried to rape her himself when the brother refused was passed fit to stand trial when he appeared in the Montego Bay Resident Magistrates' Court on Tuesday.
The accused man had been referred to the psychiatrist for assessment and the court heard last Tuesday that he was fit to stand trial. He is also to be assessed for legal aid as his mother told the court she could not afford to get an attorney for him.
The court heard that on May 1 this year, the accused was left alone with his siblings, including his 15 year-old sister and brother, when he ordered them to strip off all their clothes.
It is alleged that he had a stick in his hand that he used to threaten them, then told his brother to have sex with his sister. The younger man refused, the court heard, and he ordered him out and then tried to rape the girl.
It is understood that she fought him off and a report was made to the police. He was arrested and charged with assault with intent to rape.
He will return to court today when the case against him will be mentioned.
